Heartland Porch Pumpkins Terms and Conditions

Effective Date: July 29, 2026

These Terms and Conditions (“Terms”) apply to all purchases, bookings, deliveries, installations, gift displays, commercial projects, removal services, and other services provided by Heartland Porch Pumpkins (“HPP,” “we,” “us,” or “our”).

By placing an order, accepting an estimate, submitting payment, or authorizing us to perform services, you (“Customer” or “you”) agree to these Terms.

1. Our Services

Heartland Porch Pumpkins provides seasonal fall decorating services, which may include design, delivery, installation, styling, gift displays, and optional end-of-season removal.

The specific products and services included in your order will be shown in your online order, invoice, estimate, proposal, or written agreement.

2. Natural Product Variations

Pumpkins, gourds, hay bales, mums, and other natural materials vary in color, size, shape, texture, and appearance. Product photos, website images, past installations, mockups, and AI-generated renderings are provided as examples and inspiration only.

Your finished display will be individually designed based on your property, selected package, available seasonal inventory, and the professional judgment of our styling team. We do not guarantee an exact recreation of any photograph or mockup.

Reasonable substitutions may be made when a particular variety, color, size, or decorative item is unavailable. Substitutions will be of comparable quality and overall value whenever reasonably possible.

3. Orders and Payment

Full payment is due at checkout unless a different payment schedule is stated in a written commercial proposal or invoice.

Prices are subject to applicable taxes, delivery charges, service-area fees, and approved add-ons. An order is not confirmed until payment or the required deposit has been received and HPP has accepted the order.

Customers are responsible for providing accurate contact, delivery, installation, and billing information. Additional charges may apply when incorrect information causes a failed delivery, return trip, or significant delay.

4. Scheduling

Requested installation dates are not guaranteed unless expressly confirmed by HPP. Installation times are approximate and may be affected by weather, traffic, product availability, property conditions, or other circumstances outside our reasonable control.

You do not need to be home during installation if we have permission to access the designated area. HPP may adjust an installation date or arrival window when necessary and will provide notice when reasonably possible.

5. Customer Cancellations and Refunds

Because we reserve limited seasonal installation space and purchase perishable products for each order, the following cancellation policy applies:

  • Cancellations made before products have been purchased and more than 14 calendar days before the scheduled installation date are eligible for a refund less a 10% administrative and payment-processing fee.
  • Once products have been purchased for the order, or when the cancellation is made 14 calendar days or fewer before installation, the order is nonrefundable.
  • Approved refunds will be returned to the original payment method when possible.
  • Installation dates may be rescheduled subject to availability, but a requested date change is not guaranteed.

Cancellation requests must be submitted in writing to info@heartlandporchpumpkins.com.

If HPP must cancel an order and cannot provide a reasonable replacement date, the Customer will receive a refund for the portion of the order that was not completed.

6. Weather and Unforeseen Circumstances

HPP may postpone, reschedule, modify, or pause an installation when weather or property conditions create an unreasonable safety risk or could damage products or property.

Rain, wind, heat, cold, frost, hail, wildlife, insects, irrigation systems, vandalism, theft, and other outdoor conditions can affect natural products. Weather-related rescheduling does not automatically qualify an order for a refund.

HPP is not responsible for delays or failure to perform caused by severe weather, natural disasters, government actions, product shortages, transportation interruptions, illness, labor shortages, or other events reasonably outside our control.

7. Property Access and Installation Conditions

The Customer authorizes HPP and its team members to enter the designated driveway, walkway, porch, entrance, patio, garden bed, or commercial installation area for the limited purpose of completing the ordered services.

Before our arrival, the Customer must:

  • Provide safe and reasonable access to the installation area.
  • Secure pets and keep children away from the work area.
  • Remove fragile, valuable, or obstructive items.
  • Inform us of security gates, access codes, sprinklers, loose steps, unstable railings, hidden hazards, or other relevant property conditions.
  • Obtain any required landlord, property manager, homeowners association, or business approval.

HPP may refuse or modify an installation if the area is unsafe, inaccessible, structurally unsuitable, or substantially different from the information provided when the order was placed.

Return visits caused by inaccessible or unsafe conditions may require an additional fee.

8. Care of the Display

Once installation is complete, the Customer is responsible for the display and its surrounding area.

To help protect the display, Customers should avoid excessive watering, direct sprinkler exposure, standing water, moving or stacking pumpkins, and placing open flames or heat sources near pumpkins, hay bales, dried materials, or decorations.

HPP is not responsible for damage, deterioration, staining, pests, theft, vandalism, weather exposure, animal activity, irrigation, misuse, neglect, or alterations occurring after installation.

Pumpkins and decorative produce are provided for display purposes. HPP does not represent that they are intended or certified for human or animal consumption.

9. Natural Deterioration

Pumpkins and other organic materials naturally soften, fade, discolor, mold, rot, or break down over time. The lifespan of a display depends on temperature, moisture, sunlight, airflow, handling, and other environmental conditions.

Natural deterioration is not considered a product defect. Unless the Customer purchased a separate care or maintenance plan, HPP does not guarantee replacement of products that deteriorate after installation.

If an item appears damaged at the time of installation, the Customer should notify HPP within 24 hours and provide photographs so that we can review the concern.

10. Changes After Installation

Customers may rearrange or remove items after installation, but doing so ends HPP’s responsibility for the design, stability, appearance, and condition of the altered portion of the display.

HPP is not responsible for injuries or property damage resulting from items being moved, stacked, altered, or used for a purpose other than their intended decorative use.

11. Optional End-of-Season Pickup

End-of-season pickup is included only when specifically listed in the Customer’s order or purchased as an add-on.

Pickup dates and arrival times are approximate. The display must remain accessible on the scheduled pickup date. HPP will remove the pumpkins and materials originally supplied by HPP that remain in the designated display area.

Pickup does not include removal of unrelated decorations, extensive cleaning, stain removal, pest treatment, or landscaping repair. Items that have been moved to another location may not be collected unless arrangements are made in advance.

Pumpkins collected through our pickup service may be transported to a farm, composted, donated, or otherwise responsibly repurposed when their condition permits.

12. “You’ve Been Pumpkin’d” Gift Deliveries

The purchaser is responsible for providing the correct recipient name, address, delivery instructions, and handwritten note.

By ordering a gift delivery, the purchaser represents that they have the lawful authority to request delivery to the designated property and authorizes HPP to use the ordinary walkway, porch, or entrance for delivery.

HPP may decline or modify a delivery if the location is unsafe, inaccessible, restricted, or unsuitable. Gift deliveries may be left without the recipient being present. Exact delivery times are not guaranteed.

Messages containing threatening, discriminatory, harassing, unlawful, or otherwise inappropriate content will not be delivered.

13. Commercial Installations

Commercial orders may be governed by an additional estimate, proposal, or service agreement. If a written commercial agreement conflicts with these Terms, the written commercial agreement will control for that particular project.

The commercial Customer is responsible for obtaining property-owner approval, identifying permitted installation areas, and disclosing public-access or safety requirements.

14. Photographs and Marketing

HPP will not use identifying photographs of a private residence or Customer without permission.

If the Customer separately gives permission, HPP may photograph the completed display and use those images on its website, social media, advertising, portfolio, and other promotional materials. Permission may be withdrawn for future use by contacting us in writing, but withdrawal will not require HPP to recall materials already printed or published.

15. Property Damage and Liability

HPP will use reasonable care while working on the Customer’s property. The Customer understands that natural products may release moisture, soil, plant material, dye, or residue and that hay bales and decorative materials may shed.

To the fullest extent permitted by law, HPP is not responsible for indirect, incidental, special, or consequential damages arising from an order or display.

HPP’s total liability relating to an order will not exceed the amount the Customer paid for that order, except where a different limitation is prohibited by law. Nothing in these Terms excludes liability that cannot legally be excluded, including liability resulting from HPP’s gross negligence or willful misconduct.

Property-damage concerns must be reported promptly after discovery and should include photographs and a description of the issue.

16. Website and Intellectual Property

Website content, package names, photographs, graphics, logos, designs, written materials, and marketing content belonging to Heartland Porch Pumpkins may not be copied, reproduced, sold, or used for commercial purposes without written permission.

We make reasonable efforts to keep website information accurate, but availability, pricing, descriptions, service areas, and scheduling may change. If a material website error affects an order, HPP may correct the error, offer a reasonable alternative, or cancel and refund the affected portion of the order.

17. Disputes

Before filing a legal claim, the Customer agrees to contact HPP and allow us a reasonable opportunity to review and resolve the concern.

These Terms are governed by the laws of the State of Nebraska, without regard to conflict-of-law rules. Any legal proceeding relating to these Terms must be brought in a court of competent jurisdiction in Nebraska, unless applicable law requires otherwise.

18. Severability and Waiver

If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions will remain in effect.

A failure by HPP to enforce any provision on one occasion does not waive the right to enforce it later.

19. Changes to These Terms

HPP may update these Terms periodically. Changes apply to orders placed after the revised Terms are posted. The Terms in effect when an order is placed will govern that order unless both parties agree otherwise in writing.
